On the Oral Origin of Law, from Sunna to Shari'a

The Arabic Papyrology Database (APD), a research project at the Department of Near Eastern Studies, Ludwig-Maximilians-Universität (LMU), University of Munich in Germany contains over three thousand documents. Based on research done on these documents it is possible to affirm that the word Sharīʿa does not appear in legal documents concerning transactions, muʿāmalāt, before the 13th century. Other formulas are used, mostly the term Sunna. These results point towards an understanding of the law as largely an oral tradition.
